IMDA urges dealers to update websites ahead of new digital compliance rules

The Independent Motor Dealers Association (IMDA) is urging independent dealerships to update their websites following the introduction of new legal requirements under the Digital Markets, Competition and Consumers Act.

A recent Trading Standards inspection of an established IMDA member highlighted several changes to how pricing and business information must be presented online, as well as how consumer rights are communicated.

Among the new legal obligations, all advertised vehicle prices must include any mandatory charges such as delivery fees or administration costs related to the Road Fund Licence.

Dealers must also clearly communicate any applicable cancellation or withdrawal rights, particularly where online or distance selling is involved.

Businesses must further publish full and accurate business details on their websites. This includes the legal business name, any trading name if different, and – where finance is offered – visible FCA registration numbers along with a clear financial disclosure.

The IMDA praised the swift response of its member following the Trading Standards visit and is encouraging all dealers to act swiftly to ensure their own digital presence complies with the new legislation.

“This is not just about ticking boxes for compliance,” the association said in a statement. “It’s about reinforcing customer trust, safeguarding your business from enforcement action, and upholding the standards of the independent dealer community.”

The IMDA is offering ongoing support to members during the transition, but stresses that ultimate responsibility lies with individual businesses.

IMDA chairman Umesh Samani said: “This highights when government legisation changes how important it is that they reach out to associations like the IMDA so we can share up to date best practices with our members to ensure they are operating compliantly and following government guidelines.”
